Tom Carson’s recent paper on “Deception and Withholding Information in Sales” contains a critique of my contribution to sales ethics. In this response I outline the approach I develop in two earlier papers and address the four criticisms Carson makes. These criticisms are largely based on a misunderstanding of my position. I suggest that our fundamentally different approaches to applied ethics may lie at the root of Carson’s misunderstanding. Carson uses what I call a theory-application model (...) in which the search for justification interms of fundamental rules is central, while I attempt to contextualize ethical judgments and consider alternative ways of structuring social roles. In contrasting these approaches I raise the question of which way of doing applied ethics is likely to be more fruitful. (shrink)

"At places distant from where you are, but also uncomfortably close," writes David Takacs, "a holocaust is under way. People are slashing, hacking, bulldozing, burning, poisoning, and otherwise destroying huge swaths of life on Earth at a furious pace." And a cadre of ecologists and conservation biologists has responded, vigorously promoting a new definition of nature: biodiversity --advocating it in Congress and on the Tonight Show; whispering it into the ears of foreign leaders redefining the boundaries of science and (...) politics, ethics and religion, nature and our ideas of nature. These scientists have infused the environmental movement with new focus and direction, but by engaging in such activities, they jeopardize the societal trust that allows them to be public spokespersons for nature in the first place. The Idea of Biodiversity analyzes what biodiversity represents to the biologists who operate in broader society on its behalf, drawing on in-depth interviews with the scientists most active today in the mission to preserve biodiversity, including Peter Raven, Thomas Lovejoy, Jane Lubchenco, and Paul Ehrlich. Takacs explores how and why these biologists shaped the concept of biodiversity and promoted it to society at large--examining their definitions of biodiversity their opinions about spirituality and its role in scientific work the notion of biodiversity as something of intrinsic value and their views on biophilia, E. O. Wilson's idea that humans are genetically predisposed to love nature. Takacs also looks at the work of twentieth-century forerunners of today's conservation biologists--Aldo Leopold, Charles S. Elton, Rachel Carson, David Ehrenfeld--and points out their contributions to the current debates. He takes readers to Costa Rica, where a group of scientists is using biodiversity to remake nature and society. And in an extended section, he profiles the thoughts and work of E. O. Wilson. "When I'm asked, 'should we save this species orthat species, or this place or that place?' the answer is always 'Yes!' with an exclamation point. Because it's obvious. And if you ask me to justify it, then I switch into a more cognitive consciousness and can start giving you reasons, economic reasons, aesthetic reasons. They're all dualistic, in a sense. But the feeling that underlies it is that 'yes!' And that 'yes!' comes out of the affirmation of being part of it all, being part of this whole evolutionary process. And agreeing with Arne Naess that each species, each entity, should be allowed to continue its evolution and to live out its destiny... just do its thing, as we say. Why not? Merleau-Ponty’s Phenomenology of Perception (1945), written after his extensive research in psychology, anthropology, and the other social sciences and also after his intensive encounter with the thought of Husserl and Heidegger, is an attempt to leave those malevolent dualisms behind and replace them with a phenomenology that engages with beings as befits their essence and the conditions of their being: a phenomenology that no longer imposes on our experience a morally irresponsible and offensive ontology; a phenomenology that, instead, reminds us (...) of our responsibility as guardians of nature and life and brings to light very new possibilities for ethical life, community, and dwelling on the earth of this planet. This research reports on the current state of ethics and compliance programs among business organizations in the United States. Members of the Ethics and Compliance Officers Association (ECOA), the premier professional association for managers working in this field, were asked to provide in-depth responses to a series of questions covering various elements of their corporate ethics and compliance programs. The findings from this analysis indicate that ethics and compliance programs have multiple components that are implemented developmentally, are influenced by regulatory (...) and legal efforts and have evolved into more sophisticated approaches that include risk assessment and employee performance appraisal. However, these programs remain vulnerable to sufficient resource allocation by the organization to be fully effective. (shrink)

Arianne Shahvisi has argued that a doctor’s conscientious objection to abortion is a misuse of their authority which unduly burdens patients and, moreover, does not succeed in its aim of exculpating objectors from participating in perceived evil. We examine these claims in this response. First, we ask what the ‘conscience clause’ really requires of doctors and whether Shahvisi has interpreted it correctly. Second, we explore the notions of vulnerability and power in the doctor–patient relationship and cast doubt on Shahvisi’s claims (...) about these. Third, we tackle Shahvisi’s claim that conscientious objection is self-defeating because it entails remaing causally implicated in a chain of events leading to abortion. We show that this claim entails absurdity, then revisit the classical framework for the ethics ethics of co-operation to show that conscientious objection can suceed in exculpating objectors from perceived wrongdoing. Right now, you are undergoing the conscious experience of reading this text, combined with a shifting background of sensory, emotional, and cognitive coloring. The conscious experience of the reading, together with the accompanying background feel of sensation, emotion, and thought, make up how things subjectively seem to you, how things appear, as best you can tell, from your own unique point of view. Consciousness is at once acutely familiar-it makes up the experienced moments of your waking (and perhaps your dreaming) (...) life. But consciousness also raises deep and interesting philosophical questions, questions about how any mere physical subject could produce such a wonder, and questions about how there could be a seemingly private and isolated spot of personal subjectivity in an objective, impersonal world. Perhaps the challenge of developing a satisfying theoretical understanding of consciousness is beyond us-we've reached the limits of what we can comprehend. Or maybe today's shortcomings are only temporary barriers to an illuminating theory of consciousness, one properly embedding it in our scientific worldview. And possibly we already have the resources for a satisfactory theory from the way we think about things in commonsense terms. This reader provides an entry point for considering these and related theoretical questions surrounding consciousness. This introductory section begins with a brief background survey of contemporary debates on consciousness. It then provides a characterization of the notion of consciousness at issue, and considers why consciousness understood this way might be theoretically problematic. Over the past two decades, academic economics has undergone a mild revolution in methodology. The language, concepts and techniques of noncooperative game theory have become central to the discipline. This book provides the reader with some basic concepts from noncooperative theory, and then goes on to explore the strengths, weaknesses, and future of the theory as a tool of economic modelling and analysis. The central theses are that noncooperative game theory has been a remarkably popular tool in economics over the (...) past decade because it allows analysts to capture essential features of dynamic competition and competition where some parties have proprietary information. The theory is weakest in providing a sense of when it - and equilibrium analysis in particular - can be applied and what to do when equilibrium analysis is inappropriate. Many of these weaknesses can be addressed by the consideration of individuals who are boundedly rational and learn imperfectly from the past. Written in a non-technical style and working by analogy, the book, first given as part of the Clarendon Lectures in Economics, is readily accessible to a broad audience and will be of interest to economists and students alike. No mental phenomenon is more central than consciousness to an adequate understanding of the mind. Nor does any mental phenomenon seem more stubbornly to resist theoretical treatment. Consciousness is so basic to the way we think about the mind that it can be tempting to suppose that no mental states exist that are not conscious states. Indeed, it may even seem mysterious what sort of thing a mental state might be if it is not a conscious state. On this way (...) of looking at things, if any mental states do lack consciousness, they are exceptional cases that call for special explanation or qualification. Perhaps dispositional or cognitive states exist that are not conscious, but nonetheless count as mental states. (shrink)

Ned BlockÕs influential distinction between phenomenal and access consciousness has become a staple of current discussions of consciousness. It is not often noted, however, that his distinction tacitly embodies unargued theoretical assumptions that favor some theoretical treatments at the expense of others. This is equally so for his less widely discussed distinction between phenomenal consciousness and what he calls reflexive consciousness. I argue that the distinction between phenomenal and access consciousness, as Block draws it, is untenable. Though mental states that (...) have qualitative character plainly differ from those with no mental qualities, a mental stateÕs being conscious is the same property for both kinds of mental state. For one thing, as Block describes access consciousness, that notion does not pick out any property that we intuitively count as a mental stateÕs being conscious. But the deeper problem is that BlockÕs notion of phenomenal consciousness, or phenomenality, is ambiguous as between two very different mental properties. The failure to distinguish these results in the begging of important theoretical questions. Once the two kinds of phenomenality have been distinguished, the way is clear to explain qualitative consciousness by appeal to a model such as the higher-order-thought hypothesis. Xenophon's Socratic Works demonstrates that Xenophon, a student of Socrates, military man, and man of letters, is an indispensable source for our understanding of the life and philosophy of Socrates. David M. Johnson restores Xenophon's most ambitious Socratic work, the Memorabilia, to its original literary context, enabling readers to experience it as Xenophon's original audience would have, rather than as a pale imitation of Platonic dialogue. He shows that the Memorabilia, together with Xenophon's Apology, provides us with our best (...) evidence for the trial of Socrates, and a comprehensive and convincing refutation of the historical charges against Socrates. Johnson's account of Socrates' moral psychology shows how Xenophon's emphasis on control of the passions can be reconciled with the intellectualism normally attributed to Socrates. Chapters on Xenophon's Symposium and Oeconomicus reveal how Xenophon used all the literary tools of Socratic dialogue to defend Socratic sexual morality and debate the merits and limits of conventional elite values. Throughout the book, Johnson argues that Xenophon's portrait of Socrates is rich and coherent, and largely compatible with the better-known portrait of Socrates in Plato. A leading political theorist’s groundbreaking defense of ideal conceptions of justice in political philosophy Throughout the history of political philosophy and politics, there has been continual debate about the roles of idealism versus realism. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Utopophobia argues against thinking that justice must be realistic, or that understanding justice is only valuable if it can be realized. David Estlund does not offer a particular theory of justice, nor does he assert that justice is indeed unrealizable—only that it could be, and this possibility upsets common ways of proceeding in political thought. Estlund engages critically with important strands in traditional and contemporary political philosophy that assume a sound theory of justice has the overriding, defining task of contributing practical guidance toward greater social justice. Along the way, he counters several tempting perspectives, including the view that inquiry in political philosophy could have significant value only as a guide to practical political action, and that understanding true justice would necessarily have practical value, at least as an ideal arrangement to be approximated. The study of human behavior is severely hampered by logistical problems, ethical and legal constraints, and funding shortfalls. However, the biggest difficulty of conducting social and behavioral research is the extraordinary complexity of the study phenomena. In this article, we review the impact of complexity on research design, hypothesis testing, measurement, data analyses, reproducibility, and the communication of findings in psychological science. The systematic investigation of the world often requires different approaches because of the variability in complexity. Confirmatory testing, multi-factorial (...) designs, survey methods, large samples, and modeling are frequently needed to study complex social and behavioral topics. Complexity impedes the measurement of general constructs, the reproducibility of results and scientific reporting, and the general rigor of research. Many of the benchmarks established by classic work in physical science are not attainable in studies of more complex phenomena. Consequently, the standards used to evaluate scientific research should be tethered to the complexity of the study topic. (shrink)

According to Richard Jeffrey’s value-free ideal, scientists should avoid making value judgments about inductive risks by offering explicit representations of scientific uncertainty to decision-makers, who can use these to make decisions according to their own values. Some philosophers have responded by arguing that higher-order inductive risks arise in the process of producing representations of uncertainty. This chapter explores this line of argument and its limits, arguing that the Jeffreyan value-free ideal is achievable in contexts where methodological decisions introduce minimal higher-order (...) uncertainty and where communications of uncertainty are unlikely to be manipulated or misunderstood by scientists or decision-makers. This chapter illustrates the limits of the Jeffreyan ideal with reference to climate science and argues that the context of climate science is not conducive to the Jeffreyan ideal, so the argument that climate modeling is value-laden due to higher-order inductive risks withstands recent criticisms. Propositions are the referents of the ‘that’-clauses that appear in the direct object positions of typical ascriptions of assertion, belief, and other binary cognitive relations. In that sense, propositions are the objects of those cognitive relations. Propositions are also the semantic contents (meanings, in one sense ) of declarative sentences, with respect to contexts. They are what sentences semantically express, with respect to contexts. Propositions also bear truth-values. The truth-value of a sentence, in a context, is the truth-value of the (...) proposition that it semantically expresses, in that context. This much is common ground among many (but not all) philosophers. I accept other claims about propositions that are more controversial. Propositions (I hold) are Russellian: they are structured entities whose constituents include individuals, properties, and relations. The contribution of a proper name to the proposition that a sentence semantically expresses (in a context) is the referent of that name. Thus, the semantic content of ‘Bill Clinton’ is Bill Clinton himself, and the semantic content of ‘Bill Clinton smokes’ is a proposition whose constituents are Bill Clinton and the property of smoking (ignoring tense, as I shall do from here on). Such 1 singular propositions are among the objects of belief, assertion, and other cognitive relations. This combination of a Millian view about proper names with a Russellian theory of propositions might appropriately be called ‘Millian Russellianism’, or ‘MR’ for short. David Chalmers, in his stimulating paper “Probability and Propositions,” defines a closely related view, Referentialism, as follows (see also the penultimate paragraph of his introduction). Referentialist views say that insofar as beliefs are about individuals (such as Nietzche), the objects of these belief are determined by those individuals. On one such view, the objects of belief are Russellian propositions composed from the individuals and properties that one’s belief is about.. (shrink)

David Hume's sympathetic principle applies to physical equals. In his account, we sympathize with those like us. By contrast, Adam Smith's sympathetic principle induces equality. We consider Hume's “other rational species” problem to see whether Smith's wider sympathetic principle would alter Hume's conclusion that “superior” beings will enslave “inferior” beings. We show that Smith introduces the notion of “generosity,” which functions as if it were Hume's justice even when there is no possibility of contract.

This essay raises questions about the role of reciprocity as it pertains to the various formulations of the liberal principle of legitimacy as interpreted by Constitutional Essentials.
